These Terms of Service govern the use of the Momenty app (the "App"), provided by NK Productions, Nikita Krebs, St.-Florian-Ring 13b, 21217 Seevetal (the "Provider", "we"). By using the App you agree to these terms.
Momenty lets you record short daily video clips that are stitched into one shared daily vlog. Users can join private groups ("Logs") via a PIN and share clips with the other members. We continuously develop the App; features may change.
An account (e.g. via "Sign in with Apple") is required to use the App. You must be at least 16 years old, or have the consent of your legal guardians. You are responsible for keeping your login details confidential.
You retain the rights to the clips you record. By sharing them in a Log, you grant us and the respective Log members the simple right to store, display, and (within the Log) play back the content as part of the App's features. You are responsible for ensuring that you hold the necessary rights to your content and that you do not infringe the rights of third parties.
When using the App, the following is prohibited in particular:
In the event of violations, we may remove content and suspend accounts.
We strive for the most uninterrupted operation possible but cannot guarantee continuous availability. Maintenance, technical faults, or force majeure may lead to restrictions.
We are liable without limitation for intent and gross negligence, as well as under the Product Liability Act. In cases of slight negligence, we are only liable for the breach of essential contractual obligations and limited to foreseeable, contract-typical damage. Otherwise, liability is excluded.
You may stop using the App and delete your account at any time. We may terminate the usage relationship with immediate effect in the event of violations of these terms.
We may amend these Terms of Service where necessary. We will inform you of material changes in an appropriate manner. The current version published here applies.
The law of the Federal Republic of Germany applies. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
